How do I know how much bail is required?
Bail depends on the seriousness of the offense you have been accused of. In the case of minor offenses, an officer will often accept the defendant’s promise to appear in court at the specified date and time without appearing before a judge or posting any type of bond. More serious offenses might require you to appear before a judge so that they may set your release conditions. (In addition to bail, this can include orders to stay away from the scene of the incident or people involved in the incident.) The prosecutor asks the judge for the amount of bail, and your defense attorney has the chance to counter these arguments with evidence that you are not a flight risk and will appear in court for your scheduled hearings. The judge then decides what amount of bail is appropriate.

Will I have to stay in jail before my trial?
In the case of very serious offenses, the judge might decide not to let you post bail at all. (These circumstances usually involve murder and other very serious crimes.) In other cases, you might have the right to post bail, but the amount is so high that it is not feasible to pay it, so you will have to remain in jail until your case is resolved through a plea deal or at trial.
